This website is operated by Second Attack, LLC. Throughout the site, the terms “we”, “us” and “our” refer to Second Attack, LLC. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. By accessing or using any part of the site, you agree to be bound by these Terms of Service. We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically for changes.

2. Account Security & Registration

You agree to provide accurate, current, and complete information for all purchases and account registrations. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. Second Attack, LLC is not liable for any loss resulting from unauthorized access to your account.

3. Community & Social Media Conduct

By using our site and joining the Second Attack Discord or interacting with our Instagram (@second.attack.minis), you agree to maintain a respectful environment. We reserve the right to terminate access to our services or community for any user who engages in harassment, hate speech, disruptive behavior, or any conduct that restricts others from enjoying the Site.

5. Governing Law & Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without resort to its conflict of law provisions. You agree that any legal action arising out of these Terms shall be filed only in the state or federal courts located in Wyoming.

6. Indemnification

You agree to defend, indemnify, and hold harmless Second Attack, LLC, its employees, and affiliates from and against any claims, damages, costs, and expenses (including reasonable attorney’s fees) arising from your use of the Site, your User Content, your violation of these Terms, or your violation of the rights of any third party.

7. Intellectual Property & Copyright

  • Proprietary Rights: All content, including miniature designs, 3D sculpts, logos, text, and graphics, is the property of Second Attack, LLC and protected by U.S. and international copyright laws.

  • Limited License: You are granted a limited license to access the Site for personal use. Unauthorized reproduction, recasting, or commercial use of our designs is strictly prohibited.

  • Third-Party Trademarks: Any non-Second Attack product names or images mentioned are trademarks owned by their respective companies. Use of these names does not imply endorsement or a challenge to their trademark status.

  • Copyright Agent: If you believe material on the Site infringes your copyright, notify our agent at info@secondattack.com.

8. Limitation of Liability

The Site and all products are provided on an "as is" and "as available" basis. Second Attack, LLC shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind—including lost profits or replacement costs—arising from your use of our products. Our total liability shall not exceed the amount paid for the specific product or service.

10. Product Accuracy & Hobby Safety

  • Descriptions: We strive for accuracy, but items may be unpainted, unassembled, or vary in material (resin/plastic) as specified.

  • Choking Hazard: Our products are intended for hobbyists and collectors. They contain small parts and are not toys. Not suitable for children under age 12.

  • Chemicals: Users are responsible for following all safety instructions for paints, glues, and resins provided by the manufacturer.

11. Purchases & Billing

We reserve the right to refuse any order or limit quantities purchased per person. Prices for our products are subject to change without notice. You agree to provide current and complete purchase information for all transactions.

12. Returns & Store Credit

  • Policy: Returns on unopened merchandise may be made for an equal-value digital gift card (store credit).

  • Condition: Items must be in original, factory-sealed condition. Once a miniature has been removed from packaging, assembled, or painted, it is no longer eligible for return.

  • Shipping: The customer is responsible for all return shipping costs. Original shipping fees are non-refundable.

13. Severability & Termination

If any provision of these Terms is deemed unlawful or unenforceable, that provision shall be severed and shall not affect the validity of the remaining provisions. We reserve the right to terminate your license to use the Site at any time, without notice, for conduct that violates these Terms.

14. Shipping & Risk of Loss

Shipping dates are estimates. Second Attack, LLC is not responsible for carrier delays. Risk of loss and title for items purchased pass to you upon our delivery to the carrier. For items arriving damaged, contact support@secondattack.com within 5 days of delivery.

15. Third-Party Links & Services

We are not responsible for the content, accuracy, or reliability of third-party websites or services linked to our Site. Your use of third-party tools is at your own risk and subject to their respective terms.

16. User-Generated Content

Anything you submit to the Site (reviews, photos, comments) is “User Content.” By posting, you represent that you own the rights to the content and you grant Second Attack, LLC a non-exclusive, royalty-free, perpetual license to use and display that content for marketing or other purposes. We reserve the right to remove any User Content at our discretion.
